Terms & Conditions

Introduction

Welcome to Sidney Paul & Co. These terms and conditions (“Conditions”) apply to every product and service we supply. Please read these terms and conditions carefully before you place an order. By visiting our website or placing an order, you accept these terms and conditions. This website is for users aged 18 and over.

We sell all products on this website subject to the terms and conditions set out below. Nothing in these Conditions affects your statutory rights.

Definitions

In these terms and conditions, the words below have the following meanings:

  • “Conditions” means these terms and conditions.
  • “Product(s)” means any Sidney Paul & Co. products.
  • “Service” means any service we supply.
  • “we”, “us”, “our” means Sidney Paul & Co.
  • “Seller” means Sidney Paul & Co.
  • “you”, “your” means the customer.
  • “Buyer” means the customer.

Acceptance of These Terms and Conditions

We offer this website, and all its information, tools and services, on one condition. You must accept all the terms, conditions, policies and notices stated here.

By visiting our site or buying something from us, you engage in our “Service”. You agree to be bound by these terms and conditions (“Terms of Service”, “Terms”), including any additional terms and policies referenced here. These Terms of Service apply to every user of the site — browsers, vendors, customers, merchants and contributors of content alike.

Please read these Terms of Service carefully before you access or use our website. Using any part of the site means you agree to be bound by these Terms. If you do not agree to all the terms here, you may not access the website or use our services. Where we treat these Terms as an offer, your acceptance is expressly limited to them.

We reserve the right to refuse service to anyone, for any reason, at any time.

We may transfer your content unencrypted, not including credit card information. This may involve transmission over various networks, and changes needed to meet the technical requirements of those networks or devices. We always encrypt credit card information during transfer.

You agree not to reproduce, duplicate, copy, sell, resell or exploit any part of the Service. This also covers your use of, or access to, the Service, without our express written permission.

The headings in this agreement are for convenience only. They do not limit or affect these Terms.

Orders

Your order becomes binding as soon as we accept it. All orders are subject to availability.

If you order wallpaper, we recommend that you seek advice from a professional decorator. We do not take responsibility for over- or under-ordering wallpaper.

Check that all the details of your order are correct and suitable for your needs. This includes measurements, dimensions, product features, access and delivery.

We despatch all goods in packaging suitable for transit only. If goods arrive damaged, sign for them as damaged and contact our customer services team within 72 hours.

We do not take responsibility for goods damaged after delivery through poor handling or storage. Refusing to supply products or services to any individual or company remains our right.

We treat any extra order that results from under-ordering as a separate order; we cannot add it to a previous order. Our wallpapers are exclusive, with small print runs, so we recommend an extra roll if you are working to close measurements. This avoids delays or a missing batch number if you need more later. You can return this extra roll by courier, at your own cost, if it stays undamaged, unopened and unused.

Some products or services are available exclusively online, in limited quantities. These are subject to return or exchange only under our Return Policy.

Terms of Sale

We accept all orders placed on the website subject to these terms and conditions. To create a contract between you and us, please follow these steps.

Follow the onscreen instructions to place an order on the website. Pressing “Checkout” on the “Review Your Order” page is your offer to buy the goods at the prices shown, plus any delivery charges.

We will send you an order acknowledgement email detailing your order. This email only acknowledges your order; it is not an acceptance or confirmation by Sidney Paul & Co.

Order Acceptance and Changes

We accept your order, and complete the contract between us, once you pay in full. This applies unless we have told you we do not accept your order, or you have cancelled it. Once accepted and paid for in full, your order becomes binding, subject to your rights of cancellation. We will not accept an order if the product is unavailable, if we spot a pricing or description error, or if we cannot authorise your payment. If a product is out of stock, our customer service team will contact you about availability and a new delivery date.

We reserve the right to withdraw any product from this website at any time, and to remove or edit any information on it. We are not liable to you or any third party for withdrawing a product, whether or not it has sold. The same applies to removing or editing website content, or to refusing, unwinding or suspending a transaction after we have begun processing it.

We reserve the right, though we are not obliged, to limit sales to any person, region or jurisdiction. We may exercise this right case by case. Limiting the quantities of any product or service we offer is also our right. Product descriptions and pricing may change at any time, without notice, at our sole discretion, and we may discontinue any product at any time. Any offer for a product or service on this site is void where prohibited.

Errors, Eligibility and Payment

Our site or Service may occasionally contain typographical errors, inaccuracies or omissions. These may relate to product descriptions, pricing, promotions, offers, shipping charges, transit times or availability. We reserve the right to correct these, and to change, update or cancel orders, at any time and without prior notice — even after you submit your order.

Product colours and images are displayed as accurately as we can manage, but we cannot guarantee how your monitor renders them. Nor do we warrant that any product, service or information will meet your expectations, or that we will correct every error in the Service.

To buy on this website, you must be over 18. Register with your real name, phone number, email address and payment details. You must also provide a valid delivery address and a credit or debit card issued by a bank acceptable to us. If you buy from within the European Union, we add VAT at 20%.

Ownership

Sidney Paul & Co. owns this website, together with its copyright and database rights.

You may use the material and content on the website only for personal, non-commercial purposes. You may download it only to a single personal computer. Do not copy, reproduce, transmit, modify, publish, display, distribute, commercially exploit or create derivative works from any website material without our written permission — and do not help a third party do so either. Any other use violates our intellectual property rights.

Standard Wallpaper, Wide Width Wallpaper and Murals

We give weights, dimensions and descriptions of wallpaper in good faith, but they are approximate only. They do not form part of any contract, and do not bind us. We reserve the right to withdraw or amend the specification of any goods or pattern without further notice.

You may return wallpaper ordered in excess only if it is unopened and in sellable condition. Send returns to Sidney Paul & Co., 95 Station Rd., Marple, Cheshire SK6 6NY, within 28 days, at your own expense.

You are solely responsible for any shortfall in the quantity of rolls you order. Our wallpapers are exclusive, with small print runs, so we recommend an extra roll if you are working to close measurements. This avoids delays or a missing batch number if you need more later. You can return this extra roll by courier, at your own cost, if it stays undamaged, unopened and unused, and we will refund its cost. If stock is not available from the same batch, please allow 14–21 days for us to print and process your order.

We sell standard wallpaper by the roll, at approximately 52cm by 10m, unless otherwise stated. Other sizes on our site are 70cm by approximately 10m. Murals are 70cm wide by approximately 9m.

Paper Hanging

Please consult our website for hanging instructions and a visual reference before you install any wallpaper. Hanging paper in the wrong direction, or repeating the pattern incorrectly, is your responsibility. Prepare all surfaces properly, and consult a professional decorator if in doubt. All our wallpapers are “paste the wall” products — paste the wall, not the paper. We accept no responsibility for paper that is not hung correctly.

We cannot guarantee precise colour matching between different batches. If you re-order to match an existing product, include the batch number. Our wallpapers are exclusive, with small print runs, so we recommend an extra roll if you are working to close measurements. This avoids delays or a missing batch number if you need more later. You can return this extra roll by courier, at your own cost, if it stays undamaged, unopened and in sellable condition.

We give specifications and hanging advice, verbal or written, in good faith and for guidance only. Site conditions and skill levels are beyond our control, so we give no warranty. We accept no liability for product performance from such use, beyond the value of the goods supplied.

We display product colours as accurately as we can. However, monitor displays vary, so we do not guarantee our website shows colours accurately. We recommend ordering a sample of any wallpaper that interests you before you buy.

Cancellations and Returns

Please return products to us within 28 days of receipt, with proof of purchase.

Handle products with care, and return wallpaper rolls unopened, unused and in their original packaging, with your Returns Form.

You are responsible for the cost of returning products to us. We recommend a trackable courier service, to avoid problems if a product goes missing. We are not liable for loss or damage in transit, so use an insured, recorded-delivery service. If a returned product is lost or damaged in transit, we reserve the right to charge you for it.

Please return products to: Sidney Paul & Co., Ravenswood, 95 Station Rd., Marple, Cheshire SK6 6NY. Please keep a certificate of posting as proof.

Delivery

We will dispatch your order within 48 hours, excluding weekends and public holidays, unless the stated “lead time” says otherwise. Next-day delivery is available within the UK, though this may vary by postcode and access. Delivery delays caused by restricted access to the property are not our liability. We cannot guarantee delivery dates, but we do our best to deliver on time or shortly afterwards. If your order has not arrived within 7 days, please contact customer service so we can investigate.

Damage in Transit

We despatch all goods in packaging suitable for transit only. If goods arrive damaged, sign for them as damaged and contact our customer services team within 72 hours.

Product Use

We design all our wallpapers for interior use only. Checking that a product suits your intended use is your responsibility. Before decorating, check that the product description, colour and characteristics match your order, and that batch numbers match too.

We try to match our products to the samples shown online as closely as possible, though slight variations may occur. We accept no responsibility for these; shade can vary slightly between print batches. When ordering rolls of the same design and colour, make sure the batch numbers match.

Prices

Our prices include VAT for UK orders and exclude delivery charges, unless otherwise stated.

We show prices correctly when published, but they may change through administrative error or circumstances beyond our control, such as a change to the VAT rate.

All prices on our site include applicable UK VAT. For delivery to a UK or EU address, the price you pay includes UK VAT, shown on your VAT receipt. Orders placed outside the UK and EU are not charged VAT, though you still pay the price shown on the website. Some countries charge import duties or taxes at import — please check with your own authorities. We are not responsible for import duties on international shipments.

Payment Methods

You may pay by Visa, MasterCard, Apple Pay, Google Pay, BACS or SEPA, through the Stripe secure gateway. By paying, you confirm the card you use is yours. Card issuers apply their own validation checks and authorisation. If your card issuer refuses or fails to authorise payment for any reason, we are not liable for any delay or non-delivery. Our card acquirers process all payments, for a fee included in your purchase price. We do not charge extra for different payment methods, and we do not accept cash. Refunds go back by the method you used to pay.

We take all reasonable precautions to keep your order and payment details secure. Except where we are negligent, we are not liable for losses from unauthorised access to information you have provided.

Security Policy

Stripe, one of the largest independent payment service providers, is our Payment Service Provider. It offers a secure, Level 1 PCI DSS payment gateway and processes payments for thousands of online businesses, including ours. Handling transaction data safely and securely is Stripe’s top priority.

Stripe uses a range of secure methods, including fraud screening, IP address blocking and 3D Secure. Once data reaches Stripe’s systems, it is secured using 256-bit encryption, an internationally recognised standard.

Stripe is PCI DSS compliant to the highest level and runs regular security audits. Banks and banking authorities also audit Stripe regularly to confirm its systems stay secure.

You can confirm your session is encrypted by checking for “https://” and a locked padlock symbol in the address bar. Buying through our site means your payment is fully protected.

Find more information about shopping securely with Stripe at stripe.com/docs/security/stripe.

Risk and Title

No order binds you or Sidney Paul & Co. until we accept it. Title and ownership pass to you when we dispatch the products to the postal service or our carriers, or when you pay in full — whichever comes first. Risk passes to you on delivery.

If a court or administrative body finds any provision of these terms invalid or unenforceable, the rest remain in full force and effect.

You may not assign or sub-contract your rights or obligations under these terms, or any related order, without our written consent. We reserve the right to transfer, assign or subcontract our own rights or obligations under these terms, or any related contract, to a third party.

Waiver

If we fail to exercise or enforce a right under these terms, this does not waive that right. It does not stop us enforcing it later either.

Amendments to These Terms & Conditions

We reserve the right to amend these terms at any time. Amendments take effect once posted on the website. Checking the terms each time you use the website is your responsibility; continued use means you accept the latest version.

Website Content and Third-Party Links

We take reasonable care to keep product details, descriptions and prices correct when uploaded. We aim to stay accurate and up to date, but clerical errors mean the website may not always reflect a product exactly. If we spot an error, we may decline to accept an order, subject to your statutory rights.

We make no representations about other websites you access through ours, or that link to ours. Any site you reach that way operates independently, and we have no control over its content or availability. Linking to another site does not mean we endorse it or accept responsibility for its content. We are not liable for any loss, damage or offence connected with your use of, or reliance on, any other website.

Certain content, products and services in our Service may include material from third parties.

Third-party links on this site may lead you to sites not affiliated with us. We do not examine or evaluate that content for accuracy, and we accept no liability for third-party materials, websites, products or services. We are not liable for harm or damage related to your use of goods or content connected with a third-party website. Review each third party’s own policies before you transact with them. Direct any complaints about third-party products to that third party.

Intellectual Property

Sidney Paul & Co. owns the property rights in all material and content on this website.

Liability and Warranties

Nothing in these terms limits our liability for death or personal injury caused by our negligence or fraud.

We are not liable for economic losses, including lost profits, revenue, business, contracts, management time, data or anticipated savings. Nor are we liable for loss of goodwill or reputation, or for indirect loss, whether arising in contract, tort or otherwise — even where such damage was foreseeable or we were told it was likely. This excludes fraudulent or negligent misrepresentation. Except for death or personal injury, our liability will not exceed the amount you paid for the goods. This does not affect your statutory rights or your rights of cancellation.

Data Protection and Privacy

We respect the privacy of your personal data and comply with all relevant data protection law. We will not disclose your personal data to anyone, unless a court of competent jurisdiction requires it.

To update or delete personal information on our mailing list, please contact us. To process your order, we store and process your data, sharing it only with a third-party courier.

Your personal data stays confidential with us. From users, we ask for the following information: surname, first name, date of birth, personal and delivery address, profession, company, telephone number, and personal and company email addresses.

Collecting this information lets us keep a record of our customers and understand how best to meet their needs. We use your personal data to:

  • process an order;
  • gather statistics to improve our services;
  • deliver our services to customers efficiently;
  • administer our website; and
  • keep customers up to date on new products or promotions.

We take the security of our customers’ personal data seriously. Please contact us at [email protected] with any questions on this subject.

Prohibited Uses

In addition to the other prohibitions in these Terms, you may not use the site or its content to:

  • pursue any unlawful purpose;
  • solicit others to perform or take part in unlawful acts;
  • violate any international, federal, provincial or state regulation, rule or law, or local ordinance;
  • infringe our intellectual property rights or those of others;
  • harass, abuse, insult, harm, defame, slander, disparage, intimidate or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin or disability;
  • submit false or misleading information;
  • upload or transmit viruses or other malicious code that could affect the Service or any related website;
  • collect or track the personal information of others;
  • spam, phish, pharm, pretext, spider, crawl or scrape;
  • pursue any obscene or immoral purpose; or
  • interfere with or circumvent the security features of the Service, any related website, or the internet.

We reserve the right to terminate your use of the Service, or any related website, if you breach any of these prohibited uses.

Indemnity

You agree to fully indemnify, defend and hold harmless Sidney Paul & Co. This covers our officers, directors, employees, agents, suppliers, parent, subsidiaries, affiliates, partners, contractors, licensors, service providers, subcontractors and interns. It applies to all claims, liability, damages, losses, costs and expenses, including reasonable legal fees. These must arise from your breach of the Conditions, the documents they incorporate, or any law or third-party right — or from another person’s use of the website through your shopping account or personal information.

Disclaimer of Warranties; Limitation of Liability

Service Availability

We do not guarantee that your use of our Service will be uninterrupted, timely, secure or error-free. Nor do we guarantee that results from the Service will be accurate or reliable. From time to time, we may remove the Service for indefinite periods, or cancel it, without notice.

Limitation of Liability

You use the Service, and our products, entirely at your own risk. Except as we expressly state, we provide the Service and all products “as is” and “as available”. We give no warranty or condition of any kind, express or implied, including merchantability, fitness for a particular purpose, durability, title and non-infringement.

Sidney Paul & Co., and our directors, employees, affiliates, agents, contractors, interns, suppliers and licensors, will not be liable for any injury, loss or claim. This includes direct, indirect, incidental, punitive, special or consequential damages of any kind — such as lost profits, lost revenue or loss of data. It applies whether based in contract, tort or strict liability, and covers any error, omission, loss or damage connected with content made available through the Service, even where we knew such damage was possible.

Jurisdictional Exceptions

Some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages. In those jurisdictions, our liability is limited to the maximum extent the law allows.

Termination

Obligations and liabilities incurred before termination survive the termination of this agreement. These Terms remain effective until you or we terminate them. You may terminate at any time, by telling us you no longer wish to use our Services, or simply by ceasing to use our site.

We may terminate this agreement at any time without notice if, in our sole judgment, you fail (or we suspect you have failed) to comply with any term. You remain liable for all amounts due up to the date of termination. We may also deny you access to any part of our Services.

Entire Agreement

If we fail to exercise or enforce a right under these Terms, this does not waive that right. Together with any policies or operating rules we post on this site, these terms and conditions form the entire agreement between you and us. They govern your use of the Service, superseding any prior agreements or communications, oral or written, including earlier versions of the Terms. We will not construe any ambiguity in these terms against the party that drafted them.

Changes to the Terms of Service

You can review the current version of the Terms of Service on this page at any time. We reserve the right, at our sole discretion, to update, change or replace any part of it by posting changes to our website. Checking our website periodically for changes is your responsibility. Continuing to use or access our website or Service after a change means you accept it.

Mobile Terms of Service

Sidney Paul & Co.

Sidney Paul & Co. operates the Sidney Paul & Co. mobile message service (the “Service”). Using the Service means you agree to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service, or any of its features, without notice. To the extent the law allows, we may also modify these Mobile Terms at any time; continued use after a change takes effect means you accept it.

Consent to SMS Messages

Consenting to our SMS/text messaging service means you agree to receive recurring messages from, or on behalf of, Sidney Paul & Co. We send these through your wireless provider, to the number you provided, even if it is on a Do Not Call list. We may use an automatic telephone dialling system or other technology to send them. Service-related messages may include order updates and account alerts. Promotional messages may include offers such as cart reminders.

Signing up for this program is not required to make a purchase, and consent is not a condition of any purchase with Sidney Paul & Co. Participation is entirely voluntary.

Message Frequency and Charges

We do not charge for the Service, but you are responsible for any charges your wireless provider applies to text messaging. Message frequency varies, and message and data rates may apply — check your mobile plan for details. You are solely responsible for all charges related to SMS/text messages, including those from your wireless provider.

Opting Out

You may opt out of the Service at any time. Text the keyword STOP to SidneyPaul, or click the unsubscribe link in any text message where available. You will receive a one-time opt-out confirmation, and we will send no further messages unless you initiate them. If you have subscribed to other Sidney Paul & Co. mobile programs, opt out of each one separately, following the instructions in its own mobile terms, except where the law requires otherwise.

Support

For Service support, text HELP to SidneyPaul or email [email protected].

Changes to Our Short Code

We may change the short code or telephone number we use for the Service at any time, and we will notify you of any change. A message you send to a changed short code or number, including a STOP or HELP request, may not reach us. We are not responsible for honouring requests sent that way.

Carrier Liability

The wireless carriers that support the Service are not liable for delayed or undelivered messages. Provide us with a valid mobile number, and sign up again with your new number if it changes.

To the extent the law allows, we are not liable for failed, delayed or misdirected delivery of information sent through the Service. The same applies to errors in that information, or to any action you take, or do not take, in reliance on it.

Privacy

We respect your right to privacy. To see how we collect and use your personal information, please see our Privacy Notice.
